[JIRAALIGN-951] Split story 1 moves from current state and shouldn't

Issue Summary

When we split stories the split story 1 changes to the in progress state no matter what state the story is currently in. When it changes states it also doesn't show in the audit log.

Steps to Reproduce

1. 1 - Split Story (That's in the Dev Complete State)
2. 2 - Save split and notice the two split stories

Expected Results

Split one should remain in the state it's currently in when split and not move to in progress.

Actual Results

The story original split story moves to the in progress state and it shouldn't.

The below exception is thrown in the xxxxxxx.log file:

Workaround

User has to manually change the state back to the prior state

No work around that's ideal
