For this upgraded data, JIRA 4.0 is showing wrong result for filter searching on status field. Seems 2 status having same name is the culprit

Steps:
1. Upgrade JIRa 4.0 with customer data from https://support.atlassian.com/browse/JSP-39167
2. Login as admin/sphere.
3. On the dashboard, click on filter "All Open Issues, All Projects, All status" used in a pie chart.

Result:
1. It show user 847 issues in JIRA 4.0 and 734 issue in 3.13.5
2. Investigation shows that user has two status defined with same name "In Progress (Services)" and they are used in different workflows.
3. JIRA 4.0 is searching for issues with the second "In Progress (Services)".

Expected:
1. Correct queries should be run.
