Issue Summary

The "Issues without epic" option in the Epic filter is not working in the enhanced Jira board and backlog when the Epics panel is disabled

Steps to Reproduce

1. In a company-managed project, turn on the "Enhanced Jira board and backlog"
2. Create some issues with and without Epics linked in the project
3. Activate the backlog feature and disable the Epic panel
4. Try using the "issues without Epic" filter

Expected Results

Issues not associated with an Epic should be displayed

Actual Results

Some issues with Epics are returned

Workaround

Some possible workarounds:

1. Create a custom filter with the JQL parent is empty
2. Enable the Epic panel for the board
3. Disable the enhanced board and backlog feature
