Error when trying to add the latest revision of a file to a Review if comment is present on previous revision

Using only Crucible if you try to add the latest revision of a file to a review it is already in but has comments on the section representing the last review the following error message is received;

....& in the logs;

2015-03-05 08:39:41,292 WARN  [qtp2052243497-13529 ] fisheye Review-removeFRXRevision - FRXRevision 709 has comments and cannot be deleted.

This only occurs when using adding in the following method;

1. Add Content
2. Explore Repositories
3. Select Repo & then files
4. Select the latest revision from the drop down for the file
5. Error is shown

Adding the latest revision in the following way completes successfully;

1. Add Content
2. Browse Changesets
3. Select the repo
4. Select the tick box next to the revision wanting to be added
5. New revision is added
